The duties that spring from the landlord-tenant relationship are proscribed by a few sources – statutory law, the common law, or the lease itself. State statutory law mainly regulates the provisions contained in a lease; however, federal statutory law does prohibit certain types of discriminatory practices. These laws create rights and they also impose duties on both parties and provide remedies if one party fails to perform their duties satisfactorily under the terms of the agreement. Many cities around the country have also enacted housing codes and other local ordinances to set minimum standards for living conditions and to further regulate landlords’ and tenants’ rights and duties.
