Are you an attorney who feels that our adversarial system is just not meant to solve some types of personal and business conflicts? Have you ever thought of looking for a better way to solve disputes to come to a better resolution for both parties involved? Well… maybe there is.

In this CLE course you will learn about collaborative law, a relatively new and unique process used to resolve disputes where both parties retain separate lawyers whose only job is to help the parties settle their disputes. The goal of this course is to present the collaborative process to legal professionals who are interested in a comprehensive process that creates an non-adversarial environment where the focus of the process is achieving the best resolution for both parties – without litigation.

In this introductory course, collaborative law attorney Katherine E. Miller will provide a brief history of the evolution of the collaborative process & paradigm shift, discuss the collaborative process & the roles of the professionals involved, teach the basic skills required for a successful collaboration and address the place of the law in the collaborative process. Additional subjects covered include the dispute resolution continuum, the collaborative roadmap, collaborative divorce attorneys, the neutral coach model, the two coach model, the financial specialist, the child specialist, the two essential concepts, understanding interests, framing the issues, reference points for decisions and developing & evaluating options.

Katherine Eisold Miller is a prominent collaborative lawyer and family mediator with a practice located in Westchester County and New York City, New York. After a decade of child welfare and matrimonial litigation, she abandoned the court system in search of a better way for families to resolve disputes. Becoming a mediator in 1990 and one of the first and best-known Collaborative lawyers in the New York metropolitan area, Mrs. Miller has dedicated her career to educating the public about the importance of choosing a way to get divorced once the decision to divorce or separate is made. She has been a guest speaker on local television and radio stations and is regularly quoted in newspapers and magazines. She is president of the board of the New York Association of Collaborative Professionals, a member of the bar of the states of New York and Connecticut, and is admitted to practice before the U.S. District Courts for the Eastern and Southern Districts of New York and Connecticut.
