Join David T. Armstrong, founder and headmaster of the Institute for Conflict Management, for a thorough, in-depth discussion of commercial arbitration. The course runs through a sample arbitration in order to teach some fine points of communicating with the parties, including how to recognize and neutralize individual biases and filters to ensure just decisions, how to diffuse “Power Distance” issues, and neutralizing the controlling behavior of dominant parties.
Armstrong also teaches how to recognize high-context and low-context communication styles and Mono-chronic and Poly-chronic cognitive perspectives and how to get the most from both types of people. The course also discusses the Uniform Arbitration Act, specific case law, and the arbitrator’s duty to follow the law as opposed to crafting a decision that is just and equitable. Armstrong also runs through the five steps of arbitration and discusses the different contexts that arbitration arises, from contracts for medical services to purchases of home computers.
